Spoky (the "Service") is operated by Бул Реолтор ЕООД (Bul Realtor EOOD)(the "Company", "we", "us"). By creating an account, subscribing or using the Service, you ("you", the parent or legal guardian) enter into a binding agreement with the Company on these Terms. You confirm you are at least 18 years old and have authority to accept these Terms on behalf of the child who will use the Service.
Spoky is an AI study buddy for children aged 7–13, covering math, science, English, reading, history, geography, art and coding basics. It is an educational tool only and does not provide medical, psychological, legal or financial advice. Outputs are generated by AI and may be inaccurate; a parent or teacher should verify important information. Do not rely on Spoky for graded assignments.
Spoky is offered as a paid subscription (currently $7.99 / month or $69 / year). Subscriptions auto-renew at the end of each billing period at the then-current price until cancelled. You may cancel at any time from the in-app Manage subscription link; cancellation takes effect at the end of the current paid period, and you retain access until then. Prices are in USD; VAT or local sales tax is added at checkout where applicable.
Payments are processed by Stripe through Stripe Managed Payments. Stripe acts as the Merchant of Record for our orders: it processes your payment, calculates and collects VAT / sales tax, and issues your receipt. Your card statement may show the charge as LINK.COM* SPOKY. Stripe's terms are available at stripe.com/legal/consumer.

You are responsible for keeping your login credentials confidential and for all activity under your account. Provide accurate information and keep it up to date. Notify us immediately of any unauthorised use.
You agree not to use the Service to request or generate, and you will not allow the child to request or generate:
We may filter, refuse, or remove outputs; suspend or terminate accounts; and report illegal activity to the authorities.
You are responsible for prompts entered into the Service, how you use the outputs, verifying their accuracy, and ensuring you have the rights to any input content. Outputs are not professional advice. We may moderate, restrict, or refuse outputs at our discretion. If you believe content infringes your rights, contact us at support@spokyapp.com; repeated infringement will result in termination.
The Service, its software, content, branding, and documentation are owned by the Company and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for personal, non-commercial family use under your active subscription. You may not resell, redistribute, sublicense, or circumvent any technical limits.
We may suspend or terminate access for: material breach of these Terms, non-payment, security or fraud risk, abuse of the safety filters, or repeated/serious policy violations. You may stop using the Service and cancel your subscription at any time. On termination, your right to use the Service ends; locally-stored chat history remains on your device until you clear it.
The Service is provided "as is" and "as available". We do not guarantee uninterrupted, error-free, or perfectly accurate operation. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.
To the fullest extent permitted by law, the Company's aggregate liability arising out of or relating to the Service is limited to the fees you paid for the Service in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special or consequential damages, including loss of profits, data or goodwill. Nothing in these Terms excludes liability for fraud, death or personal injury where such exclusion is prohibited by law.
You will indemnify and hold the Company harmless from claims arising from your misuse of the Service, your content, your breach of these Terms, or violations of law.
We may update these Terms from time to time. Material changes will be announced in the app or by email; continued use after the effective date means you accept the new Terms.
These Terms are governed by the laws of Bulgaria, without regard to its conflict-of-laws rules. Disputes will be submitted to the competent courts of Bulgaria, without prejudice to mandatory consumer-protection rights in your country of residence.
Only a parent or legal guardian (18+) may create an account. By ticking “I am the parent/guardian and I give consent” you confirm this and consent to your child using Spoky under your supervision.
Spoky is designed to comply with children's privacy laws in every market it serves — including the EU/UK GDPR and UK Children's Code, COPPA (US), PIPEDA and Quebec Law 25 (Canada), the Australian Privacy Act and Children's Online Privacy Code, India's DPDP Act, POPIA (South Africa), PDPA (Singapore) and the data-protection laws of Nigeria, Kenya, Ghana, the Philippines and Jamaica.
